§ 2-33. Planning commission.

  • (a)

    Creation and membership. A planning commission consisting of nine members shall be appointed by the mayor with the advice and consent of the council, to serve respectively for the following terms: three for one year, three for two years, three for three years; the successor to each member so appointed to serve for a term of three years. The planning commission shall appoint a chair from among the members of the planning commission. The council shall have the power to remove any member of said commission for cause and after a public hearing. Vacancies upon the planning commission shall be filled for the unexpired term of the member whose place has become vacant in the manner herein provided for the appointment of such member.

    (b)

    Meetings. All meetings of the planning commission shall be held at the call of the chair or at the request of a majority of the members of said commission. All hearings conducted by the planning commission shall be open to the public. The planning commission shall keep minutes of its proceedings showing the vote of each member upon every question, or if absent or failing to vote indicating such fact, and shall also keep records of its hearings and other official actions. Findings of fact shall be included in the minutes of each case and the reasons for recommending or denying shall be specified. Every requirement, decision, or determination of the planning commission shall be filed immediately with the council and shall be a public record. The planning commission shall adopt its own rules of procedure not inconsistent with the statutes of the State of Minnesota or with the Zoning Chapter of the City Code.

    (c)

    Quorum. No hearing shall be conducted by the planning commission without a quorum, consisting of the majority of all the members, being present. The concurring vote of the majority of the members voting shall be necessary to any action by the planning commission.

    (d)

    Jurisdiction and duties. The planning commission shall have the following jurisdiction and duties:

    (1)

    To prepare and recommend to the council a comprehensive plan for development of the city. The plan shall include reasonable requirements for streets, public grounds, and other public facilities and for the use of land within the corporate limits.

    (2)

    To recommend to the council changes to the comprehensive plan.

    (3)

    To prepare and recommend to the council plans for specific improvements pursuant to the comprehensive plan and to aid the council in the development and completion of such projects.

    (4)

    To hear, review and offer recommendations to the council on applications for conditional uses, and planned unit development under the Zoning Chapter.

    (5)

    To initiate procedures for changes and amendments (district rezonings and text) to the Zoning Chapter and to hold the required public hearing, and review and recommend appropriate action to the council in the manner specified in the Zoning Chapter.
